What happens next
On receipt of a valid notice we remove or disable access to the identified material promptly, notify the seller who posted it, and record a copyright strike against that seller's account.
Counter-notice
If your material was removed and you believe that was a mistake or misidentification, you may send the designated agent a counter-notice containing: your physical or electronic signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your district (or, if outside the United States, the Southern District of Florida) and that you will accept service of process from the person who filed the original notice. Unless that person notifies us within 10 business days that they have filed a court action, we may restore the material within 10–14 business days of receiving a valid counter-notice.
Misrepresentation
Under 17 U.S.C. §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees.
Repeat infringers
We track copyright strikes per account and terminate, in appropriate circumstances, the accounts of sellers who are repeat infringers.
